These Terms and Conditions (“Terms”) govern your use of the website at inphinitydesign.com (the “Website”). The Website is operated by Inphinity Design Pty Ltd (ACN 697 213 862) (ABN 15 697 213 862) (“Inphinity Design”, “we”, “us”, “our”), an Australian proprietary limited company.
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. About us
Inphinity Design is a wellness-focused design studio. We provide spatial, interior, and conceptual design services. Where a project requires registered architectural services, we partner with locally registered architects in the relevant jurisdiction. Our work is guided by our proprietary Resonance Tuned Design methodology.
2. These Terms are separate from any services contract
These Terms govern your use of the Website only. They do not form a contract for design or other services.
If you engage Inphinity Design to deliver services, that engagement is governed by a separate written contract (typically a Master Services Agreement) between you and us. Where there is any inconsistency between these Terms and a signed services contract, the services contract prevails in relation to that engagement.
3. Use of the Website
You may use the Website for lawful purposes only. You must not:
4. Intellectual property
All content on the Website — including text, images, graphics, logos, design concepts, the Resonance Tuned Design name and methodology, videos, and other materials — is the property of Inphinity Design or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-transferable, non-exclusive licence to access and view content on the Website for personal, non-commercial purposes, provided you do not modify it and you credit Inphinity Design where appropriate. Any other use — including reproduction, modification, republication, or commercial use — requires our prior written consent.
5. No professional advice
Content on the Website is provided for general information only. It is not professional design, engineering, architectural, legal, financial, or medical advice, and should not be relied on as a substitute for advice from a qualified professional engaged for your specific circumstances.
6. No warranties
The Website and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or availability of the Website or its content.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified.
7. Affiliate links and recommendations
The Website may include links to products or services offered by third parties. Some of these are affiliate links, which means we may receive a commission if you make a purchase after clicking on the link, at no additional cost to you.
We only include affiliate links to products or services we genuinely consider relevant to our audience. The fact that we receive a commission does not influence our editorial choices, but you should make your own assessment before purchasing.
8. Third-party links
The Website may also contain links to third-party websites and resources that are not operated by us. We provide these links for convenience only. We are not responsible for the content, privacy practices, products, or services of those third-party sites, and inclusion of a link does not imply endorsement.
9. Limitation of liability
To the maximum extent permitted by law, Inphinity Design, its directors, employees, and contractors are not liable for any indirect, incidental, consequential, special, or punitive loss or damage, or any loss of profits, revenue, business opportunity, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Website — whether in contract, tort (including negligence), under statute, or otherwise.
Where liability cannot lawfully be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant content or service, or paying the cost of having it re-supplied.
Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.
10. Privacy
Your use of the Website is also governed by our Privacy Policy, available at inphinitydesign.com/privacy-policy. By using the Website you acknowledge that information you provide is handled in accordance with that Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “last updated” date. Your continued use of the Website after any change constitutes acceptance of the updated Terms.
12. Assignment
We may assign, transfer, or subcontract our rights and obligations under these Terms to a related entity or a successor in connection with a sale or restructure of our business, on giving reasonable notice on the Website. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
13. General
You agree to indemnify and hold Inphinity Design harmless from any loss, damage, liability, claim, or expense (including reasonable legal costs) we incur arising out of your breach of these Terms or your unlawful or unauthorised use of the Website. This indemnity does not apply to the extent the loss or damage was caused by us.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect.
A failure or delay by us in enforcing any provision of these Terms is not a waiver of that provision or our right to enforce it on any later occasion.
14. Governing law and jurisdiction
These Terms are governed by the laws of the State of Queensland, Australia, and the applicable Commonwealth laws of Australia. The courts of Queensland have non-exclusive jurisdiction to hear any dispute arising out of or in connection with these Terms.
